By accessing or using the WPCursor platform at wpcursor.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

WPCursor is an AI-powered WordPress development platform that enables users to build, customize, and manage WordPress websites through natural language conversation. The Service includes:

• AI-assisted widget creation and customization
• Code snippet development and deployment
• Theme and design system management
• WordPress content management via MCP tools
• Browser automation and visual verification
• Image generation and optimization

To use the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 16 years old to create an account. By registering, you represent that you meet this age condition.

You agree to use the Service only for lawful purposes. You may not:

• Use the Service to create malware, phishing sites, or any malicious content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service to violate any applicable laws or regulations
• Distribute spam, harmful code, or engage in any activity that disrupts the Service
• Resell, sublicense, or redistribute the Service without our written permission
• Use automated tools to scrape, crawl, or extract data from the Service beyond its intended API usage
• Infringe on the intellectual property rights of others through your use of the Service

Your Content: You retain ownership of all content you create using the Service, including widget templates, code snippets, design configurations, and website content. You grant WPCursor a limited license to process and store this content solely to provide the Service.

Our Platform: The WPCursor platform, including its software, design, documentation, and branding, is owned by WPCursor and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described here.

Open Source: Some components of the Service may use open-source software, which is subject to its respective licenses.

Certain features of the Service necessitate payment. By subscribing to a paid plan, you agree to:

• Pay all fees associated with your chosen plan
• Provide valid and current payment information
• Accept that fees are non-refundable except as needed by law or as stated in our refund policy

We may change our pricing with 30 days' notice. Free credits included with new accounts expire after 12 months if unused.

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may temporarily suspend the Service for:

• Scheduled maintenance (with advance notice when possible)
• Emergency security updates
• Circumstances beyond our reasonable control

We are not liable for any loss or damage resulting from Service interruptions.

To the maximum extent permitted by law, WPCursor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to WPCursor in the 12 months preceding the claim.

You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your account if you violate these Terms.

Upon termination:

• Your right to use the Service ceases immediately
• We will retain your data for 30 days to allow you to export it
• After the retention period, your data will be deleted or anonymized
• Any outstanding payment obligations survive termination

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will meet your specific obligations, that results obtained from using the Service will be accurate or reliable, or that the Service will be error-free.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
